Section 157A – Protection of Security of India.

Without any limitations mentioned in this act, the Central Government shall,

  • not disclose any information relating to any patentable invention or application filed for the grant of a patent, if it considers it to be harmful to the security of India.
  • take any action including revocation of any patent which is already granted if it considers necessary on the grounds of security of India by issuing a notification in the Official Gazette.

“Security of India”, term includes any matter which,

is taken in the time of war or other emergency in international relations.

relates to fissionable materials or materials from which they are derived (eg., uranium, plutonium etc.,); or

relates to the transport of arms, ammunition and implements of war and to such transport of other goods and materials directly or indirectly towards supplying a military establishment; or
